This limited warranty is valid for purchases of the Narrative Clip 2 (including any part thereof) and accessories originally purchased directly from Narrative (each, a “Product”) made after Jan 23rd 2017.
Subject to the Exclusions and Limitations below, Third Dot AB (“Narrative”) warrants to the end user purchaser (“Customer”) that Products (except Bonus Mounts (as defined below)) will be free in all material respects from manufacturing defects, under normal and intended use as described in the applicable Product documentation furnished by Narrative (“Documentation”), for a period of one (1) year from Customer’s original date of purchase of the applicable Product from Narrative or Narrative’s authorized reseller (“Warranty Period”). If any Product fails to conform to the foregoing warranty and Narrative receives a valid written claim within the Warranty Period, Narrative will, at Narrative’s option and expense, (a) use commercially reasonable efforts to repair or replace the defective Product or part with a new or refurbished Product or part, or (b) accept the return of the defective Product and refund to Customer the full purchase price of the defective Product. The foregoing warranty is Narrative’s sole obligation and Customer’s sole and exclusive remedy for any defects in the Products. Repair or replacement of a defective Product or part does not extend the original Warranty Period for such Product.
Exclusions and Limitations. This warranty does not apply to: (a) damage resulting from abuse, misuse, accident, or negligence (b) normal wear and tear, (c) defects caused by alterations, modifications, repair and servicing not made or authorized by Narrative, (d) damage caused by handling, operating, storing, and using the Product outside the permitted or intended uses described in the Documentation, including but not limited to use in wet conditions, (e) defects that are not reproducible by Narrative, (f) data or content loss, and (g) mounts that are labeled as “bonus mounts” and/or “additional mounts” on the web store at the time of purchase and/or that are labeled as such at the time of delivery (“Bonus Mounts”).
Instructions to Obtain Warranty Service. In order to receive any remedy under this Limited Warranty, Customer must follow instructions set forth in the Return Policy section entitled “How to Return a Product for a Refund or Warranty Claim”.
Disclaimer. EXCEPT TO THE EXTENT SET FORTH ABOVE IN THIS LIMITED WARRANTY, THE PRODUCTS ARE PROVIDED ON AN “AS IS” BASIS, THE ENTIRE RISK AS TO QUALITY AND PERFORMANCE OF THE PRODUCTS IS WITH CUSTOMER, AND CUSTOMER ASSUMES THE COST OF ANY SERVICING, REPAIR, OR REPLACEMENT OF THE PRODUCTS. NARRATIVE DISCLAIMS ALL OTHER WARRANTIES OR CONDITIONS WITH RESPECT TO THE PRODUCTS, WHETHER IMPLIED, EXPRESS, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT OF THIRD PARTY RIGHTS. NARRATIVE DOES NOT WARRANT THAT THE PRODUCTS ARE ERROR-FREE OR WILL FUNCTION WITHOUT INTERRUPTION. TO THE EXTENT THAT NARRATIVE MAY NOT, AS A MATTER OF APPLICABLE LAW, DISCLAIM CERTAIN IMPLIED WARRANTIES OR CONDITIONS, THE DURATION OF ANY SUCH IMPLIED WARRANTY OR CONDITION SHALL BE LIMITED TO THE SHORTER OF THE WARRANTY PERIOD OR THE MINIMUM TIME PERIOD PERMITTED UNDER SUCH LAW.
Limitation of Liability. IN NO EVENT SHALL NARRATIVE BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR DATA LOSS OR CONTENT LOSS ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE USE OF OR INABILITY TO USE ANY PRODUCT, EVEN IF NARRATIVE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. NARRATIVE’S AGGREGATE CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THIS LIMITED WARRANTY AND THE USE OF, OR INABILITY TO USE, ANY PRODUCT, WHETHER IN CONTRACT OR TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE PRICE PAID BY CUSTOMER FOR SUCH PRODUCT.
Consumer Protection. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS LIMITED WARRANTY SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
Governing Law. This limited warranty shall be governed by the laws of the State of California, USA, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.
CONSUMERS WITHIN THE EUROPEAN UNION/EUROPEAN ECONOMIC AREA
The Narrative One-Year Limited Warranty referred to above do not apply to consumers within the European Union/European Economic Area. Instead, Consumers within the European Union/European Economic Area are covered by national consumer protection laws or regulations. Thus, the rights of Consumers within the European Union/ European Economic Area with regard to purchase of Narrative’s Product will governed by applicable national legislation governing the sale of consumer goods.
